Employers are required to abide by the Federal Government’s Fair Labor and Standards Act when setting wages and tracking the time worked of their employees. However, all too often employers take advantage of their position of power, especially in times of high unemployment, by refusing to pay employees overtime and paying employees below the minimum wage. Employers continue to use these unfair practices because they assume that employees will not know the rights that they are entitled to under the Fair Labor and Standards Act.

“Non-exempt” employees are entitled to overtime pay for any hours worked over 40 in a single workweek, even if those hours were worked off of the employer’s premises. Any time spent working for the benefit of the employer must be paid, and “off-the-clock” work is strictly prohibited.

Even salaried employees can be deemed “non-exempt”, and entitled to overtime pay, if they make no more than $455 per week OR are not performing duties of an exempt employee.
